A prime example of crown prosecutors trying to save face. Hopefully they will be proven wrong and hopefully fired.

It's one thing when there is a 'he said - she said' robbery or burglary, and the homeowner shoots someone, but this was none of that ordinary stuff, it was, in the words of the report. . . "fire-bombing"...

He lives not too far from me. I have been following in the papers the court case. It is a joke to real people, only anti gunners think that the police will show up in an instant unlike in the real world where it can take up to 30 minutes. The law in Canada based on anti gunners is die first and then let the family deal with the problem. It is not their problem so they do not care!

You see, this is why it's better to revolt and sever all ties with england that to wait around until you are sorta set free. Seems like our friends to the north need a Declaration of Indepence from their own government. Followed swiftly by a new Constitution and their own Bill of Rights. Sadly though, the only likely change is further restriction either by law, or a fear stricken populace resulting if more innocent people being killed.

Someone more informed on the law might clear this up but IIRC Texas law specifies that deadly force may be used to prevent someone burning your house down.

To me, living as I do where even an ambulance is a 20 min. response, and deputies often far longer, two pegs stuck in the woodwork above the front door to keep babies from getting to it is "safe storage" for my HD rifle. That's where it lives. One in the shop/office too.

Like someone else said, here in southeast Bama he would have gotten in trouble for not finishing what he started.

If the story is as it is portrayed in the article prosecuting Thomson is so wrong on so many levels. I can only hope the magistrate is a sensible soul and dismisses the case with prejudice so he may never be charged with it again. Or, the Canadian public makes such a stir that the pressure forces the prosecutor to drop the charges. Then the prosecutor gets canned. Unbelieveable.

I believe this trial will usher in "Castle Doctrine" as a law in Canada. This nonsense and abuse of prosecuters powers is just what is needed to wake up Canadians and demand self defence laws be improved. We will see CCW up here in my lifetime.

Until the Castle law was passed, it depended on what jurisdiction you were in. Rural... you probably wouldn't be prosecuted for protecting your property with deadly force. I think that in Texas, we could easily make the case that the attackers using molotov coctails were using deadly force, therefore the Castle Doctrine applies. I hope to never be in that situation, but I seriously doubt that I would have the intestinal fortitude to merely try to drive the attackers off. I would probably be in fear for my family's lives and shoot to stop the attack as quickly as possible. If the attackers die in the attack, that would be their problem to deal with.

I once watched a Texas Cops TV show. A very elderly widow of humble means had fired her husband's old S&W at some guys trying to steal her aluminum siding off her garage. She was terrified and they RAN away!
The responding officers were interesting for a Canadian. The older officer took the statement and inspected the damage. The young officer asked the woman for her pistol. I thought the poor old doll is about to loose her gun and maybe get charged. The young constable reloaded it for her and that was that!

My heart go out to all of the Decent Canadian People. on our last fishing trip to Ontario I had a run-in with the O.P.P. and the Officer despite My complying with His requests,Yes Sir, No Sir,threw the "Book" at Me. clearly to embares Me in front of the Boys and surley to send a message "We" don't want You here. He acted like a jerk.

By contrast my dad lived in a rural area, and upon hearing noises one night, went to th window and saw two or three young people in the mouth of his garage. They were kinda noisy so he assumed they were drunk, high, whatever. He got his 10-22 from behind the door, popped the loaded mag into it, racked it and opened the door, flashlight in hand.
When he saw the kids pushing a wheel chair, a rental dad had on hand for his MIL's use, down the driveway, dad popped a couple of rounds well over their heads, sure to land in the woods beyond, and yelled "leave that alone." They left the chair and scattered. dad then called the law, told em what he had done, and that he could hear the kids in the distance up the road (no immediate threat). The 911 operator said "our deputies are almost there, please put your gun away NOW so they don't get nervous." NO ISSUE was made with popping a couple caps to run the hoodlums off.

This bothers me. The only reason for them to "get nervous" would be if the dispatcher wasn't clear about having an armed citizen on scene.The 911 operator said "our deputies are almost there, please put your gun away NOW so they don't get nervous."
When I lived near Gary IN I had a couple of occurances that necessitated me popping out of my back door, Glock & tac light in hand.
One was when someone was lasing my house and the other was when two guys with flashlights started nosing around my back yard after I had had an attempted break-in.
In the first case, a kid ran home to mama with soiled pants and mud on his face from hitting the dirt when he looked down the barrel of a .40.
The other ended with a shout of "relax! Sheriffs Deputies!" Before I got the gun up. They were totally cool about it since the had, after all, trespassed while doing a breaking followup check.
Nervous cops make me nervous.

Along these same lines, an 87 year old WWII vet, victim of several burgularies, recently fired thru a window hitting at least one of the two young men trying to break into his house. The one he hit is critical. Some governmental idiot is trying to decide if he should be prosecuted. Apparently, this idiot figured an 87 year old man is a match for two twenty something men.
While California recognized the "castle" principal quite some time ago, you actually have to wait until they are inside trying to kill you before you respond. What part of tresspassing, and attempting to enter an occupied dwelling don't these idiots understand. He's 87 for pete's sake.
On the good side, the local TV news was all over the story. They actually sided with the old guy. Surprised they weren't hollering for his head. Of course, he'll likely be sued and loose the house he was protecting.

Same way here with (the police here are very pro-gun)just be a decent person(post your property)live outside of town limits if possible and (you are good to go)
Same with northern/central Pa(they are great)
ALL of the police that I deal with like people being able to protect their families with heat if need be!
Move here! ( though living here, 99.2% chance you won't need to)
