POLITICS: Gun Show and Private Transfer BAN

Post by Modoc ED »

Just got back from town and while at the gun shop, my dealer showed me an alert from the NRA.

Evidently there is a Bill circulating in the House and Senate that would ban all gun shows and would also ban private transfers of firearms between individuals. It has bi-partisan support and is expected to pass both houses and go to the President in a month or so.

Wouldn't surprise me one bit if "W" signs it. He has shown a definite anti-gun posture lately.

Here's the problem with some of this: The belief that you are innocent until proven guilty is not always applicable. For example, during the CB1994 period, if you had an assembled EBR but had bought a receiver prior to the CB1994, YOU had to prove that you assembled the gun prior to CB1994. They, BATF / Govt, did not have to prove that you had assembled it during the ban period. I'm not a lawyer, but I believe there are some laws these days where presumption of innocence is no longer applicable ... especially as concerns gun laws.

Please, somebody correct me if I'm wrong on this. I think the general view of the public is that there is always a presumption of innocence and I'm just not sure that's true for all laws.

We are supposed to have protection against 'post facto' laws (i.e. can't be prosecuted or held accountable for something that wasn't illegal before the law was made) but as we found out with Clinton's retro-active tax hike such is not always the case. Watch out.

What? the government deciding that you are guilty before having to prove it and being able to take punitive action in anticipation of finding evidence against you?

I have diligently searched the NRA website to no avail, cant find any reference to this at all. I get the ILA alerts and not one word mentioned. Anybody got a link to this with a House or Senate bill number?

Post by brucew44guns »

How many of us marched down and voted for Ol' GW? We thought he was going to be fair with us and so much better than Gore or Kerry. Maybe he has been, but I'd bet now that his time is short he will really show his true colors. I wish we could get a bunch of farmers and truck drivers and other similar folks deciding what is right to do over in DC about guns at least, instead of the elites we have running things now.

McCain has already stated he's behing "closing the gunshow loophole" - i.e. stopping all non-government monitered (private) gun transfers.

We simply lose here.

I went back to town and the gun shop today and the owner said he had received a phone call from the leagal arm (ILA?) of the NRA with a heads up. The NRA said they would be putting something out on this in the near future.

It's not as funny as some of you evidently think it is. I'm an old guy and have pretty much run my course and will probably enjoy gun ownership for the rest of my life but you young guys will be sucking hind-tit if something like this goes through. So instead of giggling about it you ought to start feeling your Representatives in Congress out and letting them know how you feel about it.

In my one on one discussions, it tends to be the Old Guys who have the "so what - I'm good 'till I die" attitude...

I guess they are close enough to Death to give up...

Oh well. I don't mind being the Elder Radical...

Yes, but remember, "McCain is the less of two evils." Now, doesn't THAT make you FEEL much better? The New York Times and the Washington Post and NBC all told us that Huckabee was a religious fanatic and Paul was 'unelectable' so what else were we to do? Geez...you sound like you wanted us to actually VOTE for who we felt was the better candidate, rather than let the media give us two socialist liberals to pick from so we could have the pleasure of picking the 'lesser of two evils.'

Sorry, I'm done ranting (...for now  )

ED,

The facts are the facts and it pretty much looks like the only canidate that I can in good concience vote for is McCain. A write in for RON PAUL does not seem like it will take our cause very far.
I will guarentee you that I do not want any anti gun legislation passed just as much as the next guy. However, I tend to agree with ScottT on this. As long as we have some good politicians in office the odds are few and far between that future is as dim towards gun ownership that many like to proclaim.
CW permits are higher than ever before and for now, there is no Assualt Weapons ban. There will always be a threat and all we can do about it is make sure we vote for the best canidate that supports our beliefs as well as keep in touch with our senators, congressmen and representatives and ensure they know our feelings.
Sorry if I didnt jump on your band wagon and declare the sky is falling. I actually thought some might appreciate the humor my previous comment brought to the situation.
Honestly, after serving 20 yrs in the military during the BUSH Sr and BUSH Jr Administration, I still have alot of faith in the man. The man has shown more CHARACTER than any politician that I can recall. His position on IRAQ has remained constant and unwaviering since 911. What other politician can you think of that can say that? Most jump on any band wagon they can to sway with public opinion and be popular!

Rice Lake gunshow is still held at a college. Our local show is still held in elementary school.

The further north, the better (although colder)
